Banking Terms of Service
Effective [effective date to be set at launch]
Applies when you open an Advi bank account. Until then, the Advi personal-finance Terms of Service apply.
These Terms govern your use of Advi, provided by Advi, LLC (“Advi,” “we,” “us”), a Wyoming limited liability company, once you open an Advi bank account. They cover Advi’s personal-finance features and your Advi bank account together. By opening an Advi bank account, you agree to these Terms. If you do not agree, do not open an account.
1. Advi and the partner bank
Advi is a financial technology company, not a bank. It provides the Advi app and the technology behind your account, and it services your account on the partner bank’s behalf as the bank’s program manager. Deposit accounts are provided by a partner bank, which is identified to you when you open your account.
- The partner bank holds the money in your account. Advi never holds your funds.
- Deposit accounts are provided by a partner bank; the bank’s terms and disclosures apply to your account.
- Your deposit account is also governed by the partner bank’s account agreement, its disclosures, its fee schedule, and, if you have a card, its cardholder agreement, all provided at account opening (together, the “account agreement”).
- If these Terms conflict with the account agreement about your deposit account or card, the account agreement controls.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use Advi. To open an Advi bank account, you must also have a Social Security number, a residential address in the United States, and a U.S. phone number, and the partner bank must be able to verify your identity. The partner bank may decline an application.
3. Opening an account and verifying your identity
Important information about procedures for opening a new account. To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: when you open an account, we will ask for your name, address, date of birth, and other information that will allow the partner bank to identify you. You may also be asked to provide a driver’s license or other identifying documents.
You agree to give accurate, complete, and current information, and to update it in the app when it changes. How we collect, use, and protect this information is described in the Banking Privacy Policy.
4. Your sign-in, contact details, and security
You sign in to Advi with a one-time code sent to your email address or mobile phone. When you open a bank account, your other contact (phone or email) is contact information for the partner bank; it becomes a way to sign in only if you choose that. Keep your email account, phone, and devices secure. You are responsible for activity under your account. Tell us promptly at support@advi.ai if you suspect unauthorized access.
5. Electronic communications (E-SIGN consent)
Advi bank accounts are offered and serviced electronically. When you open an account, you agree to receive communications electronically instead of on paper.
- What this covers. Every communication about your Advi bank account and these Terms, including the account agreement and disclosures, the fee schedule, privacy notices, periodic statements, notices of changes, error-resolution and dispute notices, transaction receipts, and tax forms the partner bank provides.
- How we deliver them. In the Advi app, by email to the address on your account, or by a link to a document in the app or on advi.ai.
- What you need. A device with a current web browser that can open and save PDF files, and an email address you check. If these requirements change in a way that could affect your access, we will tell you before the change takes effect.
- Paper copies. You can ask for a paper copy of any communication by emailing support@advi.ai. Any fee for a paper copy is shown in the fee schedule, and we will tell you about it before we send the copy.
- Withdrawing consent. You can withdraw this consent at any time by emailing support@advi.ai. Because the account is serviced electronically, withdrawing consent may lead to your bank account being closed, as the account agreement describes. Withdrawal does not affect communications already delivered.
- Keeping your details current. Keep your email address up to date in the app, or tell us at support@advi.ai.
When you give this consent at account opening, you confirm that you can open, read, and save electronic documents in the formats described above.
6. Moving money and ACH authorization
You can move money into and out of your Advi bank account in the ways the app offers. These can include direct deposit, transfers from an account you hold at another bank, transfers between your Advi accounts, and transfers to an account you hold at another bank. Limits on the amount or number of transfers may apply and are shown in the app or the account agreement. The partner bank’s funds-availability policy, in the account agreement, says when deposited money becomes available.
ACH authorization. When you ask Advi to move money by ACH between your Advi bank account and an account at another bank, you authorize the partner bank, with Advi acting on its behalf, to debit and credit those accounts for the amount and on the date you choose, and, where the ACH rules allow, to correct an error by a reversing entry. You confirm that you own, or are authorized to use, the other account, and that it is held at a U.S. financial institution.
- An authorization for a one-time transfer ends when the transfer is complete.
- An authorization for recurring transfers stays in effect until you cancel it. You can cancel by emailing support@advi.ai at least three business days before the next scheduled transfer.
- We keep a record of each authorization you give.
- ACH transfers are subject to the Nacha Operating Rules and U.S. law.
- If a transfer is returned or can’t be completed, we will tell you. Any related fee is shown in the fee schedule.
7. Debit cards
If the partner bank issues you a debit card, your use of it is governed by the cardholder agreement the bank provides at account opening. Card details are shown only through the card provider’s secure display, and Advi never stores your card number, security code, or PIN. If your card is lost, stolen, or used without your permission, freeze it in the app and tell us right away at support@advi.ai.
8. Errors, unauthorized transfers, and disputes
Tell us as soon as you can if you think a statement or receipt is wrong, if you need more information about a transaction, or if you believe your card, sign-in, or device has been lost or stolen or used to make a transfer without your permission. Email support@advi.ai and include:
- Your name and the last four digits of your account number
- A description of the error or the transaction you are unsure about, and why you believe it is an error or need more information
- The dollar amount of the suspected error
The account agreement includes an error-resolution notice that explains your rights under federal law (the Electronic Fund Transfer Act and Regulation E), including how long you have to report a problem, how long an investigation can take, when you may receive a provisional credit, and how your liability for unauthorized transfers is limited. Advi and the partner bank will investigate each report, resolve it within the times required by law, and tell you the result.
9. Statements
Statements for your Advi bank account are provided electronically in the app, as described in section 5. Review each statement and report any problem as described in section 8.
10. Interest and fees
If your account earns interest, the rate is set by the partner bank, disclosed to you at account opening, and may change as the account disclosures describe. Fees for your Advi bank account, if any, are as disclosed in the fee schedule provided at account opening. We will tell you before a new fee or a fee increase takes effect, as the account agreement and the law require.
11. Closing your account
You may close your Advi bank account at any time by contacting support@advi.ai. The partner bank or Advi may restrict, suspend, or close your account as the account agreement and the law allow, for example to comply with the law, to prevent fraud or loss, or if you break these Terms or the account agreement. When an account closes, any remaining balance is returned to you as the account agreement describes.
12. Complaints
Send complaints about Advi or your Advi bank account to support@advi.ai. We will acknowledge your complaint and work with the partner bank to resolve it. You can also contact the partner bank directly using the contact details in the account agreement, or submit a complaint to the Consumer Financial Protection Bureau at consumerfinance.gov/complaint.
13. Advi is not financial advice
All content in Advi — including your score, insights, comparisons, and coaching — is for informational and educational purposes only. It is not financial, investment, tax, or legal advice, and Advi is not your fiduciary, broker, or investment adviser. You are solely responsible for your financial decisions. Consult a qualified professional before acting.
14. AI-generated content
Advi uses a third-party large language model to generate coaching text. This content may be inaccurate, incomplete, or out of date. Do not rely on it as your only source of information. Verify any figure that matters before acting on it.
15. Connecting financial accounts
Advi uses Plaid Inc. to connect to your financial institutions. By connecting an account, you:
- Represent that you are authorized to provide access to that account
- Authorize Advi and Plaid to access and retrieve your account information on your behalf
- Agree to the Plaid End User Privacy Policy
Advi’s access to accounts you connect through Plaid is read-only. You may disconnect any connected account at any time from within the app, which revokes our ongoing access to it.
16. Acceptable use
You agree not to:
- Access another user’s account or data
- Scrape, reverse engineer, or attempt to derive the source code of Advi
- Interfere with, overload, or probe the security of the service
- Use Advi or an Advi bank account for any unlawful purpose, or for anyone other than yourself
17. Availability
We may change, suspend, or discontinue any part of Advi’s personal-finance features at any time. We do not guarantee uptime, availability, or that the service will be error-free. Changes to your bank account follow the notice rules in the account agreement and the law.
18. Intellectual property
Advi and its content, design, scoring methodology, and software are owned by Advi, LLC. Your financial data remains yours. You grant Advi a limited license to process that data solely to provide the service described in these Terms and our Banking Privacy Policy.
19. Disclaimer of warranties
ADVI IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR SCORE, CATEGORIZATIONS, OR COACHING ARE ACCURATE OR COMPLETE.
20. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVI, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR FINANCIAL LOSS ARISING FROM YOUR USE OF ADVI. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS OR ONE HUNDRED U.S. DOLLARS.
Nothing in these Terms limits any right you have under the account agreement or under laws that cannot be waived, including your rights for errors and unauthorized transfers under the Electronic Fund Transfer Act and Regulation E.
21. Termination
You may stop using Advi and ask us to delete your Advi account at any time. If you have an Advi bank account, close it as described in section 11; some records are kept after an account closes, as the Banking Privacy Policy explains. We may suspend or terminate your access if you violate these Terms or if we discontinue the service.
22. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules, and by applicable federal law. Your deposit account and card are governed by the account agreement and the law it names.
23. Resolving disputes
If you have a problem, contact us first at support@advi.ai. We will try to resolve it informally. Most disputes can be settled this way. For errors and unauthorized transfers, follow section 8.
24. Changes to these Terms
We may update these Terms. If changes are material, we will update the effective date above and notify you in the app or by email before they take effect, and with any advance notice the law requires. Continuing to use Advi after that means you accept the updated Terms.
